1. Introduction

Welcome to ADACareer ("Platform", "we", "us", or "our"). ADACareer is operated by ADACareer (in process of PT incorporation), currently under incubation at Bandung Techno Park, located in Bandung, West Java, Indonesia.

These Terms of Service ("Terms") govern your access to and use of the ADACareer platform, including our website, mobile applications, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

2. Definitions

"User" or "you": Any individual or entity accessing or using our Services.

"Job Seeker": A user seeking employment opportunities through the Platform.

"CV/Resume": Professional profile and work history submitted by users.

"AIDA": Our AI-powered career assistant chatbot.

"Account": Your registered profile on the Platform.

"Content": Any information, data, text, software, or materials uploaded to or displayed on the Platform.

3. Eligibility

To use our Services, you must:

  • Be at least 17 years old (or the age of majority in your jurisdiction);
  • Have the legal capacity to enter into binding agreements;
  • Provide accurate, current, and complete information during registration;
  • Not be prohibited from using our Services under applicable Indonesian law.

By creating an account, you represent and warrant that you meet all eligibility requirements.

4. Account Registration and Security

4.1 Account Creation

  • You may register using email, Google SSO, or LinkedIn SSO;
  • You must provide accurate and truthful information;
  • One account per person; duplicate accounts may be terminated;
  • You are responsible for maintaining the confidentiality of your password.

4.2 Account Security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.

4.3 Account Termination

You may delete your account at any time through your profile settings. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Use of Services

5.1 Permitted Use

You may use our Services to:

  • Create and optimize your CV using AI-powered tools;
  • Search for and apply to job opportunities;
  • Receive personalized job recommendations;
  • Track your job applications and saved positions;
  • Interact with AIDA, our career assistant chatbot;
  • Access career development resources.

5.2 Prohibited Activities

You agree NOT to:

  • Provide false, misleading, or fraudulent information;
  • Impersonate any person or entity;
  • Use automated systems (bots, scrapers) to access the Platform without permission;
  • Attempt to gain unauthorized access to our systems or user accounts;
  • Upload malicious code, viruses, or harmful content;
  • Harass, abuse, or harm other users or our staff;
  • Use the Platform for illegal purposes;
  • Resell or commercially exploit our Services without authorization;
  • Reverse engineer, decompile, or disassemble any part of our Platform;
  • Remove or modify any copyright, trademark, or proprietary notices.

6. CV Data and User Content

6.1 Your Content Ownership

You retain all ownership rights to the content you submit to the Platform, including your CV, profile information, and any other materials ("User Content").

6.2 License to ADACareer

By submitting User Content, you grant ADACareer a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, translate, and display your User Content for the following purposes:

  • Providing Services (B2C): To match you with relevant jobs, analyze and optimize your CV, generate recommendations, and improve your user experience;
  • Future B2B Services: To provide anonymized, aggregated talent insights to enterprise clients (recruiters, HR departments, companies) for recruitment and talent analytics purposes;
  • Platform Improvement: To train and improve our AI models, algorithms, and matching systems;
  • Marketing & Analytics: To create anonymized statistics, reports, and insights (no personally identifiable information will be shared without consent).

6.3 B2B Data Usage (Future Services)

Important Notice:

We plan to offer B2B recruitment services to companies. Your CV data may be shared with potential employers in the following ways:

  • When you apply to a job, your CV will be shared with that employer;
  • Your profile may appear in employer searches if it matches their requirements (you can opt-out in privacy settings);
  • Anonymized, aggregated data may be used for talent market insights;
  • We will NEVER sell your personal data to third parties for marketing purposes.

6.4 Content Accuracy

You represent and warrant that all information in your CV and profile is accurate, truthful, and does not violate any third-party rights or applicable laws.

6.5 Content Removal

We reserve the right to remove any User Content that violates these Terms or Indonesian law, without prior notice.

7. AI-Generated Content and Recommendations

7.1 AI Services

ADACareer uses artificial intelligence (AI) to provide CV optimization suggestions, job matching scores, career recommendations, and chatbot responses through AIDA.

7.2 No Guarantee of Accuracy

Disclaimer:

AI-generated suggestions, job match scores, and recommendations are provided for informational purposes only. While we strive for accuracy, we do not guarantee that AI outputs are error-free, complete, or suitable for your specific situation.

7.3 User Responsibility

You are solely responsible for reviewing, verifying, and deciding whether to use AI-generated suggestions. ADACareer is not liable for employment decisions, job applications, or career choices made based on AI recommendations.

7.4 Third-Party AI Providers

We use third-party AI services (OpenAI, Google Gemini, Azure AI, Mistral AI, VoyageAI) to power our features. By using our Services, you acknowledge that your data may be processed by these providers in accordance with their respective privacy policies.

8. Job Postings and Applications

8.1 Job Listings

Job postings on ADACareer are sourced from external job boards, company websites, and user submissions. We do not guarantee the accuracy, availability, or legitimacy of job postings.

8.2 Third-Party Employers

ADACareer is not the employer for jobs listed on the Platform. We act as a facilitator connecting job seekers with employers. All employment relationships, offers, and negotiations are directly between you and the employer.

8.3 Application Tracking

We provide tools to track your applications, but we are not responsible for employer responses, interview scheduling, or hiring decisions.

8.4 Reporting Fraudulent Jobs

If you encounter a fraudulent or suspicious job posting, please report it immediately through our feedback system or contact support.

9. Intellectual Property Rights

9.1 Platform Ownership

All content, features, functionality, software, code, design, graphics, logos, and trademarks on the Platform are owned by ADACareer or its licensors and are protected by Indonesian and international copyright, trademark, and intellectual property laws.

9.2 Restrictions

You may not copy, modify, distribute, sell, or create derivative works from the Platform without our express written permission.

9.3 ADACareer Brand

"ADACareer," the ADACareer logo, "AIDA," and "All Dreams Achievable" are trademarks of ADACareer. You may not use these marks without prior written consent.

10. Payments and Subscriptions (If Applicable)

10.1 Free Services

ADACareer currently offers free basic services to all users. We may introduce premium features in the future.

10.2 Future Paid Services

We reserve the right to introduce premium features, subscriptions, or paid services in the future. You will be notified of any pricing changes with reasonable advance notice.

10.3 Payment Processing

When paid services are introduced, payments will be processed through third-party payment providers (e.g., Stripe, Mayar). You agree to comply with their terms and conditions.

10.4 Refunds

Refund policies for paid services will be disclosed at the time of purchase.

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with Indonesian data protection laws, including:

  • UU No. 27 Tahun 2022 tentang Perlindungan Data Pribadi (Personal Data Protection Law)
  • PP No. 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik (Government Regulation on Electronic Systems and Transactions)

12. Disclaimers and Limitation of Liability

12.1 "As Is" Service

Important Legal Notice:

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY INDONESIAN LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Merchantability, fitness for a particular purpose, and non-infringement;
  • Accuracy, reliability, or completeness of content;
  • Uninterrupted, secure, or error-free operation;
  • Job placement, interview guarantees, or employment outcomes.

12.2 Platform Improvements

We continuously work to improve ADACareer. While we strive for quality, the Platform may occasionally experience bugs or errors. We appreciate your feedback to help us enhance the service.

12.3 No Employment Guarantee

We do not guarantee that using our Services will result in job offers, interviews, or employment. Job search success depends on many factors beyond our control.

12.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDONESIAN LAW, ADACAREER AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages;
  • Loss of profits, data, use, or goodwill;
  • Service interruptions, errors, or data loss;
  • Third-party actions (employer decisions, fraudulent job postings, etc.);
  • Damages exceeding the amount you paid to us (if any) in the 12 months prior to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless ADACareer, its directors, officers, employees, contractors, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms;
  • Your violation of any law or third-party rights;
  • Your User Content or use of the Platform;
  • Any fraudulent, negligent, or illegal conduct.

14. Termination

14.1 Termination by User

You may terminate your account at any time by contacting support or using the account deletion feature in your profile settings.

14.2 Termination by ADACareer

We reserve the right to suspend or terminate your access to the Platform immediately, without prior notice, if you:

  • Violate these Terms;
  • Engage in fraudulent or illegal activity;
  • Provide false or misleading information;
  • Abuse or harass other users or our staff.

14.3 Effect of Termination

Upon termination, your right to access and use the Services will immediately cease. We may retain certain data as required by law or for legitimate business purposes (see Privacy Policy).

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Bandung, West Java, Indonesia.

15.3 Dispute Resolution

Before initiating legal proceedings, the parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails within 30 days, either party may proceed to court.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page;
  • Notify you via email or prominent notice on the Platform;
  • Provide at least 7 days' notice before changes take effect (30 days for material changes).

Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ADACareer regarding the Services.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

17.5 Language

These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail. (Bahasa Indonesia version available upon request.)
